Joinesty, Inc. (“Joinesty,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes how Joinesty collects and uses personal information from users on our website www.joinesty.com(the “Site”) our browser extension (the “Extension”), and through our online services (“Services”). It also describes the choices available to you regarding our use of your personal information and how you can access and update your personal information. The Site and Services are owned and operated by Joinesty, Inc., 320 W.   1. A NOTE ABOUT CHILDREN

We do not intentionally gather Personal Data from visitors who are under the age of 13. If a child under 13 submits Personal Data to Joinesty and we learn that the Personal Data is the information of a child under 13, we will attempt to delete the information as soon as possible. If you believe that we might have any Personal Data from a child under 13, please contact us at the contact information provided above.

 

  1. TYPES OF DATA WE COLLECT

We may collect Personal Data from you as you use our Site and Services. “Personal Data” means data that allows someone to identify or contact you, including, for example, your name, address, telephone number, email address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. We may also collect Anonymous Data. “Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. To the extent that Anonymous Data is linked with your Personal Data, we will treat it as Personal Data.

We collect Personal Data and Anonymous Data that you provide to us directly. We may also collect Personal Data or Anonymous Data automatically, through technologies used on the Site and in the Services, as described below.

    1. Information that you provide to us directly:

Account Information: We may collect your Personal Data when you establish an account on our Site to use the Services (your “Account”). When you establish your Account, we may collect and store the following:

  • Your contact information, including: your name and email address;
  • If you choose to provide it: your zip code and your telephone number;
  • Your unique Account password that you create (“Password”);
  • If you choose to provide Membership (defined below) log-in credentials, details or notes, the separate unique PIN that you create to access this information;
  • Information that we collect and retain on your behalf, such as messages that you send, receive and store using your Account (“Messages”). This may include Membership recommendations and referral links that you may send to and receive from your Joiners (defined below); and
  • If you choose to provide it, information about your interests.

 

Membership Information: We may collect and store the information that you provide to us regarding your Memberships,” which include everywhere and everything for which you have a username, account number, email login, password and/or PIN or other unique participation credential. We may collect and store the following information regarding each of your Memberships:

  • The name of the organization, website, company, program or other group to which you belong as a member;
  • The type or category of Membership;
  • The primary location where you are a member, as applicable for a local Membership;
  • If you choose to provide it for any Membership:

o   your log-in credentials for your Membership (“Credentials”);

o   any details or notes about the Membership, such as the date on which you became a member, your account number, expiration or renewal dates, cost and billing periods, if applicable, and other information;

o   any reminders that you may set up for the Membership;

o   your referral link for the Membership;

o   your review of the Membership;

o   your rating of the Membership; and

 

  • In order to use our Extension, you will need to provide your Credentials for any Membership for which you want the Extension to automatically input such Credentials into the log-in page for such Memberships.  Credentials can be stored directly into the Extension, via the Site or via a prompt following your log-in to such Membership.  When you store Credentials using the Extension, the associated Membership will be stored on and available via the Site and when you store Credentials via the Site, the Membership will be stored on and available via the Extension.  Other users’ ability to view your Memberships via the Site will be subject to your Account’s default visibility settings or the visibility settings applicable to such Membership, which you can change at any time by accessing your Dashboard page and changing your visibility preferences. Your visibility settings do not allow any other users to see your Credentials. For more information on sharing Credentials, see below
  • Your name and time stamp when you create a Membership for any membership not automatically recognized by the Services (“Custom Membership”). We will retain your name and the time stamp in connection with the Custom Membership to track the creator of a Custom Memberships after it has been created, including after a Custom Membership is promoted as an automatically recognized membership on the Site. However, your name and the time stamp will not be shared with or visible to other users in connection with the Custom Membership.

 

Usage Information and Other Information that You Provide While Using the Site and Services:

  • We may collect certain types of Personal Data, including your photograph, interests, and city or area of residence (based on your zip code), on your Account profile page on our Site, and this information will be stored on our servers and may be viewable by your Joiners or other users on the Site through your account profile (your “Profile”). For more information regarding your Profile, including your Profile privacy settings, please click here.
  • If you contact us regarding support for the Services, we also collect other types of Personal Data, such as your operating system and version, IP address (as defined below) and other requested information.
  • If you provide us feedback or contact us via email, we will collect your name and email address, as well as IP address and operating system, and any other content included in the email, in order to send you a reply.
  • When you participate in one of our surveys, we may collect additional information about you and/or your use of the Services.
  • If you participate in a sweepstakes, contest or giveaway on our Site, we may ask you for your email address and/or phone number (to notify you if you win or not).We may also ask for first and last names, and sometimes post office addresses to verify your identity. In some situations we may need additional information as a part of the entry process, such as a prize selection choice. These sweepstakes and contests are voluntary. We recommend that you read the rules for each sweepstakes and contest that you enter.
  • We may also collect Personal Data at other points on our Site that state that Personal Data is being collected.

 

    1. Information Collected Automatically:
  • Information Collected by Our Servers. To make our Site and Services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.
  • Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information may include IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our Services to our users’ needs. For example, some of the information may be collected so that when you visit the Site or the Services again, it will recognize you, and the information could then be used to serve advertisements and other information appropriate to your interests.

 

(a)    Email Scanning. If you choose to use the email scan option offered with the Services, the Services will scan your email box to help you identify any potential memberships that you may want to include as Memberships in your Account (“Email Scan”). You may choose to automatically load any membership information that the Email Scan identifies into your Account. If the Email Scan identifies any membership information that is not automatically recognized by the Services, you will be asked if you’d like to create a Custom Membership before the Membership information is uploaded to your Account. To run the Email Scan, we will collect and store your email address along with your email account information. You can choose to disable the Email Scan at any time by accessing your Account settings.

(b)   Information You Provide to Facebook and other Social Networking Sites (“SNS”). The Services allow users to access Facebook, Twitter and other SNSs to interact with friends and to share information. Depending on whether you are already signed into the SNS or have an existing account with the SNS, you may be prompted to sign in or register with the SNS. By proceeding, you are allowing the Services to access your information and you are agreeing to the Facebook or other SNS’s Terms of Use in your use of the Services. We may receive information from Facebook or another SNS to make it easier for you to create an Account on the Site and show our relevant content from your Facebook or SNS friends. If you are already logged into the Services and Facebook or another SNS, when you click to connect, you may be prompted to merge your profiles. Once you register on the Site and connect with Facebook or another SNS, you will be able to post recent activity back to Facebook or the other SNS. We will never post to any SNS for you, or without your consent. Any information that we collect from your Facebook or other SNS account may depend on the privacy settings you have with that SNS, so please consult the SNS’s privacy and data practices. You have the option to disable your connection to a SNS at any time by logging into your Account and clicking the “disconnect” button next to the SNS in question in the Account Settings page. You can edit privacy settings for the reviews that appear on Facebook or disconnect your Services activity stream by visiting the Facebook Applications Settings page.

(c)    Social Media Widgets. Our Site includes social media features (“Features”), such as the Facebook Like button and Widgets, the Share this button or interactive mini-programs that run on our Site. These Features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the Features to function properly. Features are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.

(d)   Information About Your Friends. As part of your use of the Services, we provide you the opportunity to establish a connection with your friends or other people who are using the Services (your “Joiners”). We employ various techniques in order to help you find your friends, including offering contact importer tools to facilitate adding to your Joiner list (including, among others, Facebook friends and Gmail contacts) so that you can more readily ask your contacts to join and communicate with you through the Services. With your permission, we will access these contact lists and import your contacts’ names email addresses, and SNS system IDs to facilitate automatic connection with your friends. We do this only for contact matching to help your friends and you find each other. We do not store any passwords you may provide as part of the contact import process.

(e)   Invites. If you choose to invite a friend to use our Site and the Services, we will ask you for your friend’s name and email address. We will automatically send your friend invitation emails inviting him or her to visit the Site and join the Services as a member. Joinesty stores this information for the sole purpose of sending these invitation emails and tracking the success of our referral program. Your friend may contact us at yallcomebacknow@joinesty.com to request that we remove this information from our database.

(f)     Sharing Credentials. If you choose to share your Credentials with a third party, we will ask you for such third party’s email address. We will automatically send such third party an email with a sharing link that notifies such third party that you have shared Credentials with him or her.  Joinesty stores this information for the sole purpose of sending these emails and tracking the use of such Credentials. Such third party may contact us at yallcomebacknow@joinesty.com to request that we remove this information from our database.

(g)  Information Collected from Third Party Companies. We may receive Personal Data from third party companies. We may add this information to the information we have already collected from you via our Site in order to improve the Services we provide.

 

  1. COOKIES AND OTHER TRACKING DEVICES

 

(a)    Cookies. Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.

(b)   Pixel Tags. In addition, we use “Pixel Tags” (also referred to as clear Gifs, web beacons, or web bugs). Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, that are used to track online movements of web users. In contrast to Cookies, which are stored on a user’s computer hard drive, Pixel Tags are embedded invisibly in web pages. Pixel Tags also allow us to send email messages in a format users can read, and they tell us whether emails have been opened to ensure that we are sending only messages that are of interest to our users. We may use this information to reduce or eliminate messages sent to a user.

(c)    Flash LSOs. When we post videos, third parties may use local shared objects, known as “Flash Cookies,” to store your preferences for volume control or to personalize certain video features. Flash Cookies are different from browser Cookies because of the amount and type of data and how the data is stored. Cookie management tools provided by your browser will not remove Flash Cookies. To learn how to manage privacy and storage settings for Flash Cookies, click here:http://www.macromedia.com/support/documentation/en/flashplayer/help/settings_manager07.html.

(d)   Google Analytics and Other Analytics Tools. We may use Google Analytics, Optimizely, and/or other analytics tools (“Analytics Tools”) to help analyze how users use the Site. Google Analytics and Optimizely use Cookies to collect information such as how often users visit the Site, what pages they visit, and what other sites they used prior to coming to the Site. We use the information we get from Analytics Tools only to improve our Site and Services.   1. HOW WE USE PERSONAL DATA

 

(a)    General Use Related to the Services. In general, we use your Personal Data to respond to your requests or to aid us in serving you better. We use your Personal Data in the following ways:

  • provide the Services you request;
  • facilitate the creation of and secure your Account on our network;
  • administer and/or authenticate your Account;
  • respond to your customer service requests;
  • identify you as a user in our system;
  • enable you to store, track and organize your Membership information;
  • make Membership recommendations for you;
  • send you email reminders that you have set through your Account;
  • enable you to browse Membership recommendations;
  • facilitate sending and receiving Messages to and from your Joiners;
  • provide you and your Joiners with special offers and deals;
  • provide improved administration of our Site and Services;
  • improve the quality of your experience when you interact with our Site and Services;
  • send you a welcome email to verify ownership of the email address provided when your Account was created;
  • send you administrative notifications via email, SMS, and/or to your notification inbox on your Account, such as notifications when a Joiner signs up for a Membership that you bookmarked and security or support and maintenance advisories; and
  • send you Daily Digest emails (defined below), surveys, offers, and other promotional materials related to our Services and for other marketing purposes of Joinesty.

 

(b)   User Testimonials and Feedback. We use any feedback that you may provide to us to improve the Site and Services. We may post user feedback on the Site from time to time. If we post your feedback, we will share it with your first name and last initial only. If we choose to post your first and last name along with your feedback, we will obtain your consent prior to posting you name with your feedback.

 

(c)    Our Creation of Anonymous Data. We may create Anonymous Data records from Personal Data by excluding information (such as your name) that makes the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of our Services and improve navigation on our Site. We reserve the right to use Anonymous Data for any purpose and disclose Anonymous Data to third parties in our sole discretion.

 

 

  1. HOW WE SHARE PERSONAL DATA

Trust and Privacy are of the utmost importance to us. We will share your Personal Data with third parties only in the ways that are described in this Privacy Policy. We do not sell your Personal Data to third parties.

(a)    Third Parties Designated by You. When you use the Services, you may choose to share Personal Data with the third parties that you designate to view and/or receive such information, including your Joiners. You may share your Personal Data through your Profile (defined below) and/or through Messages that you send to your Joiners. Your Personal Data may also be shared with your Joiners through Daily Digest emails. However, these digest emails respect the privacy settings you selected for each Membership. You may change your settings at any time as to who can view your information by accessing your Account settings and changing your preferences, and by accessing your Membership Details page and changing your visibility preferences for each Membership. If you chose to share your Credentials with third parties, such third party can have such Credentials automatically inputted into the log-in page for such Memberships and may be able to see such Credentials.  You can revoke such third party access to such Credentials at any time by: selecting “revoke” or “x” from the Extension or via the Site and confirming that you wish to remove that third party’s access to such Credentials. Access will be revoked upon the expiration of that third party’s current session in the Site or the Extension.  

(b)   Third Party Service Providers. We may share your Personal Data with third party service providers to: help us with our business activities and provide you with the Services that we offer you through our Site, such as sending you emails, SMS messages, administering surveys, or offering customer service; to conduct quality assurance testing; to facilitate creation of accounts; to provide technical support; and/or to provide other services to Joinesty. These third party service providers are required not to use your Personal Data other than to provide the services requested by Joinesty.

(c)    Corporate Restructuring. We may share some or all of your Personal Data in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Data may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy. You will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of your Personal Data, as well as any choices you may have regarding your Personal Data.

(d)   Social Networking Sites. Some of our Services may enable you to post content to Social Networking Sites (“SNSs”) (e.g., Facebook or Twitter). If you choose to do this, we will provide information to such SNSs in accordance with your elections. You acknowledge and agree that you are solely responsible for your use of those SNSs and that it is your responsibility to review the terms of use and privacy policy of the third party provider of such SNSs. We will not be responsible or liable for: (i) the availability or accuracy of such SNSs; (ii) the content, products or services on or availability of such SNSs; or (iii) your use of any such SNSs.

(e)   No Disclosure to Third Party Companies for Marketing. We will not disclose your Personal Data to any third party company for the third party company’s own direct marketing purposes.

(f)     Other Disclosures. Regardless of any choices you make regarding your Personal Data (as described below), Company may disclose Personal Data if it believes in good faith that such disclosure is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on Joinesty; (c) to protect or defend the rights or property of Joinesty or users of the Site or Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use.

(g)    Disclosure to Other Third Parties Only With Consent. Joinesty may disclose your Personal Data to any other third party only with your consent to do so.

 

  1. YOUR ACCOUNT PROFILE

The Profile you create on our Site will by default be viewable by all users on the Site, to allow others to find and connect with you. However, the memberships you add to this profile are, by default, only visible to your Joiners, and you control the visibility of each membership in your profile individually, as outlined below. You may change your privacy settings to make your entire Profile private, which means it will not appear in search results for any users on the Site, including your Joiners. However, your Joiners may still view your profile through their My Joiners page. You may also select and change the categories of information that will be displayed on your Profile through the Edit Profile function on the Profile page of your Account, or on the Account Settings page. For example, you may choose to show your interests but not your location on your Profile.

The names and descriptions of any Memberships you add will by default be viewable by only you and your Joiners. You can change the privacy settings for each Membership to make all or just select Memberships private, which means that they will be only viewable by you, and not be viewable by any other user of the Site, including your Joiners. You may instead choose to change the privacy settings associated with any of your Memberships to make all or select Memberships public so that they are viewable by all users on the Site. You can also change the default visibility setting so that any memberships you add to your profile from that point onward will automatically have the selected level of visibility unless / until you choose to individually modify it or change the default setting again. Changing the default does not change the visibility setting of memberships previously stored – it only impacts memberships stored moving forward.

You can make changes to your privacy settings for your Profile and your Memberships by accessing them through your Account settings. You may also access your privacy settings for your Profile through your Profile page on the Site. If you think that an unauthorized profile is created without your permission, please contact us to remove/ delete such profile using the contact information provided above.

 

  1. ADVERTISING ON OR ABOUT OUR SITE

We may partner with third parties to display advertising on our Site and/or to manage our advertising on other sites. Certain third parties may automatically collect information about your visits to this and other websites, your IP address, your ISP, the browser you use to visit our Site (but not your name, address, email address or telephone number). They do this by using technologies such as cookies, beacons, tags and scripts. Information collected may be used, among other things, to deliver advertising targeted to your interests and to better understand the usage and visitation of our Site and the other sites tracked by these third parties. This policy does not apply to, and we are not responsible for, Cookies or Pixel Tags in third party ads, and we encourage you to check the privacy policies of advertisers and/or ad services to learn about their use of Cookies and other technologies.

If you do not wish to have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here.   1. YOUR CHOICES REGARDING YOUR INFORMATION

 

(a)    Email Communications. We will by default send you daily digest emails that provide you with membership suggestions and describe recent activity on the Site occurring between 12:00 am and 11:59 pm of the previous day for you and those of your Friends who have made their activity viewable (“Daily Digest emails”). You may choose to receive Daily Digest emails more or less frequently by modifying your preferences in your Account settings. We may also send you reminder emails and/or administrative notification emails. You may choose to “opt out” to stop receiving notification, reminder, and/or Daily Digest emails or other marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings, or you can contact us at the contact information provided above. Despite your indicated email preferences, we may send you service related communications, including notices of any updates to our Terms of Use or Privacy Policy.

(b)   De-Linking SNS. If you decide at any time that you no longer wish to have your SNS account (e.g., Facebook) linked to your Account, then you may de-link the SNS account in your Account settings. Please refer to the privacy settings of the SNS to determine how you may adjust our permissions and manage the interactivity between the Services and your social media account.

(c)    Changing or Deleting Your Personal Data. You may change any of your Personal Data in your Account or delete selected Personal Data in your Account by editing your profile within your Account settings or by contacting us using the contact information set forth above. You may delete your entire account by selecting the “Delete my Account” option in your Account Settings. Please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may also retain your information for fraud or similar purposes.

 

  1. RETENTION OF YOUR PERSONAL DATA

We will retain your Personal Data for as long as your Account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

 

  1. SECURITY

The security of your Personal Data is of utmost importance to us. We encrypt the transmission of your Personal Data using secure socket layer technology (SSL) with SHA-256 level encryption. Site Passwords are stored using SHA-512 with 256 byte salt values. Additionally, we protect any sensitive Personal Data that you enter (this includes the “Secure Content” on your account) by encrypting it at rest using a high byte depth encryption algorithm.

We also require you to enter a password to access your Account information and, as applicable, a separate PIN to protect your Membership log-in credentials. Please do not disclose your Account password or your PIN to unauthorized people. If you have any questions about security on our Site, you can contact us at the contact information provided above.

 

  1. LINKS TO THIRD PARTY SITES

Our Site includes links to third party websites whose privacy practices may differ from those of Joinesty. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

 

  1. CHANGES TO THIS POLICY

We may update this privacy policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by means of a notice on the Site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
